Grupul de Lucru Art. 29 (format din reprezentan?ii autorit??ilor de supraveghere a prelucr?rii datelor personale din statele membre ale Uniunii Europene) a dat publicit??ii, în data de 17 februarie 2015, un comunicat de pres? referitor la efectuarea unui studiu privind utilizarea modulelor cookies (fi?iere de mici dimensiuni, formate din litere ?i numere, care sunt stocate pe computerul / terminalul mobil sau alte echipamente ale unui utilizator de pe care se acceseaz? Internetul). Astfel, la sfâr?itul anului 2014, un num?r de 478 de website-uri des frecventate de utilizatorii cet??eni europeni au fost supuse verific?rii privind respectarea prevederilor Directivei 2002/58/EC, modificat? prin Directiva 2009/136/EC. Aceste directive au fost transpuse la nivel na?ional în Legea nr. 506/2004 privind prelucrarea datelor cu caracter personal ?i protec?ia vie?ii private în sectorul comunica?iilor electronice, modificat? ?i completat? prin OUG nr. 13/2012. În conformitate cu art. 27 din Legea nr. 677/2001 pentru protec?ia persoanelor cu privire la prelucrarea datelor cu caracter personal ?i libera circula?ie a acestor date, cu modific?rile ?i complet?rile ulterioare, Autoritatea Na?ional? de Supraveghere a Prelucr?rii Datelor cu Caracter Personal a efectuat, în anul 2015, investiga?ii tematice privind respectarea condi?iilor prelucr?rii datelor prev?zute de Legea nr. 506/2004, modificat? ?i completat?. Activitatea principalilor furnizori de servicii de telecomunica?ii a f?cut obiectul acestor investiga?ii tematice privind utilizarea modulelor cookies la nivelul website-urilor proprii. În urma acestor investiga?ii s-au aplicat sanc?iuni în cuantum total de 68.500 lei pentru s?vâr?irea contraven?iei prev?zut? la art. 13 alin. (1) lit. i) pentru neîndeplinirea în mod cumulativ a condi?iilor prev?zute de art. 4 alin. (5) din Legea nr. 506/2004, modificat? ?i completat?. Autoritatea Na?ional? de Supraveghere mai informeaz? c? aceste investiga?ii tematice privind utilizarea modulelor cookies au fost efectuate atât la nivelul operatorilor din sectorul public, cât ?i la nivelul operatorilor din sectorul privat.
